This Privacy Policy explains how X-Gen Systems LLC (“X-Gen”, “we”, “us” or “our”) collects, uses, shares and protects personal information when you visit xgensystems.us (the “Website”), contact us, or use our services. It also explains the privacy rights you may have under United States federal and state law.
1. Who we are
X-Gen Systems LLC is a technology company based in Houston, Texas, with a development office in Dhaka, Bangladesh. We provide website design and development, software and mobile app development, and IT management services.

2. Information we collect
Information you give us
- Contact details such as your name, email address, phone number and company name, when you fill in our contact form, email us or call us.
- Project information you choose to share with us, such as requirements, files and feedback.
- Business and billing details if you become a client, such as billing address and payment records. Card payments, if any, are handled by our payment processor; we do not store full card numbers.
Information collected automatically
- Technical data such as IP address, browser type, device type, pages visited and the date and time of your visit. Our hosting server records this in standard security logs.
- Cookies. The Website uses only the cookies needed for it to work and stay secure, such as login and security cookies. We do not use advertising cookies. If we add analytics in the future, we will update this policy first.
We do not knowingly collect sensitive personal data (such as health, financial account, precise location, racial or religious information) through the Website.
3. How we use your information
- To reply to your messages and requests.
- To prepare quotes and proposals, and to provide and support the services you hire us for.
- To send service related notices, such as project updates and invoices.
- To keep the Website and our systems secure, and to prevent spam, fraud and abuse.
- To comply with legal obligations and to protect our legal rights.
- To send occasional news about our services, only if you agree. You can unsubscribe at any time.
4. How we share information
We do not sell your personal information, and we do not share it for targeted (cross context behavioral) advertising. We share it only:
- With service providers who help us run our business, such as our website hosting and email providers, under contracts that require them to protect it and use it only for our instructions.
- With our own team in the United States and Bangladesh, only as needed to provide our services.
- When required by law, a court order or a valid government request, or to protect the rights, safety and property of X-Gen, our clients or others.
- As part of a merger, acquisition or sale of business assets, in which case we will tell you about any change in ownership.
- With your consent, or at your direction.
5. Your privacy rights
Depending on the state where you live, you may have some or all of the following rights. Many state laws apply only to larger businesses, but we offer these choices to all visitors regardless of where they live:
- Know and access the personal information we hold about you.
- Correct inaccurate personal information.
- Delete personal information you provided to us, subject to legal exceptions.
- Portability: receive a copy of your data in a usable format.
- Opt out of the sale of personal data, targeted advertising and certain profiling. We do not do any of these.
- Limit the use of sensitive personal information. We do not collect it through the Website.
- Appeal our decision if we deny your request.
- Non discrimination: we will not treat you differently for using your rights.
These rights come from laws including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Texas Data Privacy and Security Act, and the consumer privacy laws of Virginia, Colorado, Connecticut, Utah, Oregon, Florida, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky and Rhode Island.
How to make a request
Email info@xgensystems.us with the subject “Privacy Request”, or call +1 (713) 396-2484. Tell us what you are asking for. We will confirm your identity by matching the information you give us with what we hold, and we will respond within 45 days (we may extend this once when the law allows, and we will tell you if we do). You may use an authorized agent; we may ask for proof that the agent is allowed to act for you.
Appeals
If we decline your request, you can appeal by replying to our decision with the subject “Privacy Appeal”. We will answer within the time required by law, generally 45 to 60 days. If you are not satisfied, you may contact your state Attorney General.
Global Privacy Control
We honor the Global Privacy Control (GPC) browser signal as a request to opt out of the sale or sharing of personal data. Because we do not sell or share personal data for advertising, no further action is needed from you.
6. Notice to California residents
In the last 12 months we have collected the following categories of personal information: identifiers (such as name, email address, phone number and IP address), commercial information (such as services requested), and internet activity information (such as pages viewed). We collect it from you directly and from your device. We use it for the purposes in Section 3 and disclose it only to the recipients in Section 4. We have not sold or shared personal information, and we do not knowingly sell or share the personal information of consumers under 16. Under California’s “Shine the Light” law, you may ask us about disclosures to third parties for their direct marketing; we make none.
7. Children’s privacy
The Website and our services are meant for businesses and adults. We do not knowingly collect personal information from children under 13, as required by the Children’s Online Privacy Protection Act (COPPA). If you believe a child has sent us personal information, email info@xgensystems.us and we will delete it.
8. Emails from us
Any marketing email we send follows the CAN-SPAM Act: it will identify us, include our postal address, and contain a working unsubscribe link. We will act on your unsubscribe request within 10 business days. Service messages about your project or account are not marketing and may still be sent.
9. How we protect information
We use reasonable administrative, technical and physical safeguards, including encrypted HTTPS connections, access controls, strong passwords and regular software updates. No system is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you and the authorities as required by applicable state breach notification laws, including Texas law.
10. How long we keep information
We keep contact form messages and emails for as long as needed to respond and follow up, and usually no longer than 3 years. We keep client and billing records for as long as required for tax, accounting and legal purposes, generally up to 7 years. After that, we delete or anonymize the information.
11. International transfers
We are based in the United States and also work from Bangladesh. Your information may be processed in either country. We protect it the same way wherever it is processed.
12. Do Not Track
Some browsers send a “Do Not Track” signal. Because the Website does not track you across other websites, it works the same whether or not this signal is on. We do honor Global Privacy Control as described above.
13. Links to other websites
The Website may link to other websites, including projects we built for clients. We are not responsible for the privacy practices of those websites. Please read their privacy policies.
14. Changes to this policy
We may update this Privacy Policy from time to time. We will change the “Last updated” date above, and for important changes we will place a notice on the Website.
